3. AI-Assisted Research and Content — Important Disclosure

  • Any warranty that the Site will be uninterrupted, error-free, or free of viruses or harmful components;
  • Any warranty as to the accuracy, completeness, reliability, currency, or timeliness of any Content;

The foregoing disclaimer applies with full force to all Content produced with or without the assistance of AI tools. The inherent limitations of AI-generated content described in Section 3 are expressly acknowledged and form part of this disclaimer.

5. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL TOP TRUSTED PRODUCTS OR ITS OWNERS, DIRECTORS, OFFICERS, EMPLOYEES, CONTRACTORS, CONTRIBUTORS, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of profits, revenue, data, or goodwill;
  • The cost of procuring substitute goods or services;
  • Damages arising from reliance on inaccurate, incomplete, or AI-generated Content;
  • Damages arising from a product performing differently from how it was described in our Content;
  • Any other intangible losses;

WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Where liability cannot be fully excluded by law (as may apply in certain Canadian provinces under consumer protection legislation), our liability to you shall be limited to the re-supply of the information in question or, at our sole discretion, a nominal amount not exceeding CAD $100.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for certain types of damages. In such jurisdictions, our liability shall be limited to the greatest extent permitted by applicable law.

5.1 Protection for Our Owners, Directors, Officers and Team

The disclaimers in section 4 and the limits of liability in section 5 protect not only Top Trusted Products but also its owners, directors, officers, employees, contractors and agents. Each of them is an intended beneficiary of those sections and may rely on them directly, as if they had agreed to these Terms themselves.

The Site and its Content are published by Top Trusted Products as a business, not by any individual. To the fullest extent permitted by law, any claim arising from the Site or its Content may be brought only against Top Trusted Products, and not against any of its owners, directors, officers, employees, contractors or agents personally.

6. Affiliate Links and Commercial Relationships

Some links on this Site are affiliate links. When you click such a link and make a purchase, we may receive a commission. These relationships are fully disclosed in our Affiliate Disclosure. Affiliate relationships do not influence how we review or rate a product. We are not a party to any transaction between you and any retailer, and we accept no liability in connection with any such transaction.

8. Intellectual Property

10. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Province of Alberta and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any dispute arising from or relating to these Terms or your use of the Site shall be subject to the exclusive jurisdiction of the courts of Alberta, Canada.

For users located in the United States: You acknowledge and agree that the foregoing choice of law and jurisdiction is reasonable and that you submit to the personal jurisdiction of the courts of Alberta in respect of any such dispute.

12. Entire Agreement and Severability

These Terms, together with our Privacy Policy and Affiliate Disclosure, constitute the entire agreement between you and Top Trusted Products with respect to your use of this Site and supersede all prior or contemporaneous communications and proposals, whether oral or written.

If any provision of these Terms is found invalid or unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will remain in full force and effect. Our failure to enforce any provision of these Terms is not a waiver of our right to enforce it later.
